Terms of Service
Draft for review — not yet in force. Effective [[EFFECTIVE DATE]].
These terms are an agreement between you and [[LEGAL NAME]], trading as GetU Prep ("we", "us"), for the use of getuprep.com and the study packs sold there (the "Service"). By creating an account or buying access, you agree to these terms and to the pages they include:
- the Privacy Policy;
- the Refund Policy;
- the Acceptable Use Policy;
- the AI & Content Policy;
- the Cookie Notice.
1. Who can use the Service
- You must be at least 16 years old.
- If you use the Service for an employer, you confirm you may accept these terms for yourself; access is still personal to you (§3).
2. Your account
- You sign in with a one-time code sent to your email. Keep access to that inbox secure, because anyone who can read it can sign in as you.
- Give a real email you control. Tell us at support@getuprep.com if you think someone else has used your account.
3. What you get, and your licence
- A free demo: any signed-in user can take a fixed 20-question sample.
- Full access to a pack: for the period you've paid for, you get the exam simulations, topic practice, the study guide (online and as a PDF) and your progress history.
- Your licence: we give you a personal, non-transferable, non-exclusive licence to use the pack for your own exam preparation during your access period.
- The PDF is for your own use.
- All content stays ours (or our licensors'). Nothing in these terms transfers ownership to you.
- After your access ends, you keep read-only access to your past scores and results. New attempts, the guide, the PDF and question review need active access.
4. Buying access
- Price: shown before you pay, currently US$29.99 for 365 days of access to one certification pack. Checkout may show the price in your local currency.
- Payment: purchases are sold through Link, Stripe's checkout service, which acts as the reseller (merchant of record) for the sale. Link's terms apply to the payment, and Link sends your receipt and invoice. We never see or store your full card details.
- When access starts: immediately after payment is confirmed. If you buy again while your access is active, the new 365 days are added to your current end date.
- Taxes: where sales tax, VAT or GST applies in your location, Link calculates and collects it, and checkout shows it before you pay.
- The pass promise: if you meet its conditions and fail the real exam, we add another 365 days of access free. The conditions are in the Refund Policy.
- All sales are final: see the Refund Policy. Before paying, you'll ask for immediate access and confirm that no refunds apply, except where the law requires one. Where the law gives a cooling-off period for digital content, asking for immediate access means that period doesn't apply.
5. Acceptable use
Follow the Acceptable Use Policy. In short:
- don't share your account;
- don't copy, publish or resell the questions;
- don't attack the Service.
6. Exam preparation, not the exam
- No affiliation: GetU Prep is not affiliated with, endorsed by or sponsored by ServiceNow, Inc. "ServiceNow" and "Certified System Administrator" are trademarks of ServiceNow, Inc., used only to describe the exam our material prepares you for.
- No pass guarantee: we don't guarantee that you'll pass any exam. Readiness scores are estimates from your practice results, not predictions of an official score.
- How we make the content: see the AI & Content Policy. We work to keep it accurate and current, but the platform and the exam change, and errors can occur. Please report them (§9).
7. Disclaimers and limits of liability
- No warranties: to the extent the law allows, the Service is provided "as is", without warranties of any kind, including fitness for a particular purpose. We don't promise the Service will be uninterrupted or error-free.
- Limit of liability: to the extent the law allows,
- our total liability for any claim about the Service is limited to the amount you paid us in the 12 months before the claim;
- we're not liable for indirect or consequential losses, such as lost opportunities, exam fees or lost profits.
- Your statutory rights: nothing in these terms limits rights you have under consumer law that can't be excluded. Examples are the consumer guarantees under the Australian Consumer Law, and statutory rights in the UK and the EU.
8. Suspension and ending
- Your side: you can stop using the Service at any time, and you can ask us to delete your account (see the Privacy Policy).
- Our side: we may suspend or end access, without refund, if you seriously or repeatedly breach these terms or the Acceptable Use Policy. Sharing or reselling content is a serious breach.
- Chargebacks: if a payment is reversed through a lost chargeback, the access it paid for ends.
- If we close the Service: we'll give at least 30 days' notice and refund the unused part of any active access, pro rata.
9. Support and changes
- Support: email support@getuprep.com about access, billing or errors in the content.
- Changes to these terms: we may update these terms. For a material change, we'll tell active customers by email at least 14 days before it applies. The version in force when you bought governs that purchase's price and access period.
10. Governing law
- These terms are governed by the laws of the State of [[STATE]], USA. Disputes go to the courts there, unless your local consumer law gives you the right to bring proceedings where you live.
- Before going to court, contact us first, and we'll try to resolve the issue informally within 30 days.
